Thrive Now Brands Inc. provides this website (https://photographersadvantage.com) as a service to users. Throughout the site, the terms “we”, “us”, and “our” refer to Photographers Advantage. Use of our website and services signifies your acceptance of the following Payments and Refunds Terms (“Terms”), in conjunction with any applicable Client Agreements, Terms of Use, Privacy Policies, or other legally binding agreements accessible via hyperlink or on our website.

By accessing our website or purchasing any services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions stated herein, you may not access the website or use any of our products or services.

We reserve the right to update or modify these Terms at any time. It is your responsibility to check this page periodically for changes. Continued use of the website and services after updates constitutes acceptance of the revised Terms.

This website https://photographersadvantage.com is hosted on the Showit platform. Our checkout pages may also be hosted on platforms including but not limited to Clickfunnels, PayPal, Kajabi, Cognito Forms, and Stripe. These companies provide us with an online e-commerce platform that allows us to sell our products and services to you. You agree to all of these platforms’ terms and conditions in addition to the Terms outlined herein.

Purchase And Refunds

1.1. Due to the nature of our services being service-based and digital, all purchases made through Photographers Advantage are 100% non-refundable. No returns or exchanges will be accepted.

Application of Terms

2.1. These Terms apply to all products and services provided by Photographers Advantage. By registering or making a purchase, you agree to comply with these Terms, which prevail over any conflicting conditions elsewhere.

2.2. These Terms are to be used in conjunction with any Client Agreement or Terms of Use agreed upon at the time of purchase. They prevail over any inconsistent terms implied by law, trade custom, practice, or course of dealing.

2.3. Payment via our third-party processors (e.g., PayPal, Stripe, Cognito Forms, Kajabi, Clickfunnels) also signifies agreement to their respective terms and policies.

2.4. Any questions or clarifications regarding these Terms should be directed to info @ photographersadvantage.com prior to purchase.

Programs And Services

3.1. Scope of work will vary depending on the service package purchased. Deliverables may include but are not limited to:

SEO: Keyword research, technical and on-page audits, metadata optimization, content creation and distribution, backlink strategy, analytics setup, and monthly reporting.

Google Ads: Campaign creation, ad copy, keyword targeting, budget management, conversion tracking, and performance reporting.

GBP Management: Profile optimization, keyword/location audits, content and review strategy, post creation, and reporting.

Website Builds: Depending on the selected package, pages may include homepage, service pages, about, contact, and terms.

Payment Terms

4.1. Setup fees, one-time charges, and recurring payments are due as indicated on checkout pages, invoices, or signed contracts. For Google Ad management, you agree to spend the monthly minimum budget as agreed upon at checkout or on the sales call.

4.2. All fees are non-refundable. Delinquent accounts may incur late fees, interest, administrative fees, or suspension of service.

4.3. We reserve the right to charge a late fee of $200.00 USD and apply interest of 3% for past-due balances. Each month after that will incur a $200.00 USD late fee in addition to 3% interest until payment is received in full. Repeated late payments may result in service termination. If a payment defaults, we have the right to automatically charge the card on file until the default payment is received in full. If a new payment plan must be created due to failed billing, a $200 administration fee applies.

4.4. You are responsible for paying the full amount originally agreed for any service, regardless if you leave the program, do not complete it, do not use the program or service, or if Photographers Advantage, owned and operated by Thrive Now Brands Inc. discontinues the service for any reason.

4.5. Photographers Advantage, owned and operated by Thrive Now Brands Inc. reserves the right to assign delinquent accounts to a collections agency and report activity to applicable credit agencies.

4.6. Nothing herein shall limit Photographers Advantage, owned and operated by Thrive Now Brands Inc. from seeking payment for any chargeback or credit card dispute made by you. By accepting these Terms, you waive the right to initiate chargebacks or payment disputes with your credit card provider for services rendered or agreed to. Any such disputes will be contested to the fullest extent permitted by law. If you initiate a chargeback, we reserve the right to report your account to credit bureaus and/or send the matter to collections.

4.7. Client is responsible for any applicable state or federal taxes.

4.8. You agree to provide current, complete, and accurate billing and contact information for all purchases.

Cancellations And Terminations

5.1. If the client purchased agency services and coaching or consulting services, the initial term of this agreement is six months, starting from the execution of this agreement or the first payment made to Photographers Advantage, owned and operated by Thrive Now Brands Inc. Thereafter, the agreement will automatically renew every month until terminated for any reason by either party. If the client elects to terminate, a 30-day notice must be submitted in writing.

5.2. All cancellation requests must be submitted via email to info @ photographersadvantage.com. There is a one business day turnaround for execution of the request.

5.3. Management fees apply unless/until the Client has submitted an official request to pause or cancel management.

5.4. Due to the nature of optimizations, a cancellation or pause mid-billing cycle will not result in a refund of any type.

5.5. On or before the Contract’s termination date, Client must immediately pay any unpaid fees or other sums payable under these Terms. Photographers Advantage, owned and operated by Thrive Now Brands Inc. has the right to charge the Client’s credit card or method of payment on file for remaining unpaid fees without notice.

5.6. Cancellation does not warrant any refund. All services rendered before the effective date of cancellation are billable.

5.7. Photographers Advantage, owned and operated by Thrive Now Brands Inc. reserves the right to terminate services at its discretion for breach of these Terms or misuse of the platform.

Google Ad Management Additional Terms

6.1. If the Client submits a budget update, the update is assumed to apply to the current calendar month unless otherwise stated.

6.2. If the Client decreases the Ad budget mid-month, the remaining budget may not be sufficient to continue campaigns and could result in a pause.

6.3. If the full monthly budget is not spent, the remaining balance will roll over to the following month.

6.4. Photographers Advantage, owned and operated by Thrive Now Brands Inc. is not responsible for overspending up to 20% above the monthly account budget.

6.5. Unauthorized changes by third parties in ad accounts are not allowed. First infraction results in a warning, second in a penalty fee equal to one month’s management fees, and third in account cancellation.

6.6. You are responsible for paying your ad spend directly to Google. Photographers Advantage, owned and operated by Thrive Now Brands Inc. is not responsible for campaigns not running due to payment issues.

6.7. Monthly management fees are billed based on your budget, not actual Ad spend. These fees will not be adjusted.

6.8. Management fees apply unless/until the Client has submitted an official pause or cancellation request.

6.9. Photographers Advantage, owned and operated by Thrive Now Brands Inc. is not responsible for any ad spend over the weekend if the Client submits a cancellation/pause request on a Friday.

6.10. Cancellation means all campaigns will be paused, tracking numbers released, and landing pages deleted.

Liability Disclaimer

7.1. We do not guarantee specific results. Your success depends on various factors beyond our control, including your market, background, and efforts.

7.2. Our total liability shall not exceed the price of one month’s service paid by you.

7.3. We shall not be liable for any loss, including indirect or consequential damages, data loss, or lost profits resulting from your participation in our services.

7.4. Delays caused by your actions or external factors shall not be the liability of Photographers Advantage, owned and operated by Thrive Now Brands Inc.

No Guarantee of Results

7.5. While we provide strategies, tools, and services designed to improve your online visibility and lead generation, we do not guarantee any specific outcome, revenue increase, or performance metric. Success depends on multiple factors beyond our control.

Force Majeure

7.6. We are not liable for failure to perform any obligation under this agreement if such failure is caused by events beyond our reasonable control, including but not limited to acts of God, government restrictions, natural disasters, cyber attacks, or labor disputes.

Consumer Rights

7.7. If you are a resident of California, the European Union, or any jurisdiction offering statutory data rights, you may have rights including access to your personal information, deletion of records, or data portability. To make such a request, please email info @ photographersadvantage.com. We comply with all applicable privacy and consumer data laws.

Marketing Communication

7.8. By purchasing a service or opting in to a free resource, you consent to receive periodic promotional emails. You may unsubscribe at any time by using the link in the footer of any email or by contacting us directly.

General Conditions

8.1. Clients must be 18 years or older and legally capable of entering contracts.

8.2. Communication will be primarily electronic. You agree that electronic communication satisfies legal requirements.

8.3. These Terms are governed by the laws of Florida, United States. All disputes shall be handled exclusively within U.S. courts.

8.4. No failure or delay by us in exercising any right under these Terms shall constitute a waiver.

8.5. If any provision is deemed unenforceable, it shall be severed without affecting the remainder of the Terms.

8.6. You may not assign your rights or obligations under this agreement without our written consent.

8.7. We may transfer or assign our rights at any time.

Indemnification

9.1. Clients agree to defend, indemnify, and hold harmless Photographers Advantage, owned and operated by Thrive Now Brands Inc. and any affiliates or team members from claims, losses, liabilities, or expenses arising from service use or breach of these Terms.
